1. Agreement Overview
These Terms of Service (the “Terms”) govern your access and use of the website hyggecycle.com (the “Site”) operated by HyggeCycle (“we”, “us”, “our”), as well as all purchases, orders and communications made through the Site.
By browsing, accessing, registering an account, placing an order or using any services on this Site, you agree to be bound by these Terms and our Privacy Policy. If you do not accept these Terms, you must not use our website or place any orders.
These Terms apply to all visitors, users, customers and other parties accessing the Site.
2. Eligibility
You must be at least 18 years old to place an order on this Site. If you are under 18, you may only use the Site with supervision and consent of a parent or legal guardian. You represent that all information you submit during checkout or account creation is true, accurate, complete and current.
3. Products & Product Descriptions
We sell carbon bicycle frames, wheelsets and related cycling components. We strive to display product images, specifications, geometry data, weights, colours and descriptions as accurately as possible. However, monitor display differences, material batch variations and manual measurement tolerances may cause minor discrepancies. Images are for illustration purposes only and do not constitute a binding warranty.
Custom frame orders are subject to separate custom specifications confirmed by you before production. Once custom production begins, cancellation may not be permitted.
All products are subject to availability. We reserve the right to discontinue any product at any time without prior notice.
4. Pricing & Payment
All prices shown on the Site are [specify: USD / EUR] unless otherwise stated. Prices do not include import duties, customs taxes, VAT, brokerage fees or shipping charges, which are the sole responsibility of the buyer.
We reserve the right to adjust product prices at any time. Price changes will not affect confirmed paid orders.
Payment must be completed through our authorized payment gateways. You authorize us to charge your selected payment method for all ordered items plus applicable shipping fees. We reserve the right to cancel orders in cases of suspected fraud, incorrect pricing errors, unavailable inventory or failure of payment verification.
5. Order Acceptance & Fulfillment
Your submission of an order form constitutes an offer to purchase. An order is only accepted by us once we send you an order confirmation email. We retain the right to reject or cancel any order for any reason before shipment.
After order confirmation, we will arrange production and shipment in accordance with the published lead time. Lead times are estimated and not guaranteed. Delays may arise from manufacturing, material shortage, logistics or customs issues. We will notify you of significant delays as soon as possible.
You are responsible for providing a valid, complete shipping address. We are not liable for delivery failures caused by incorrect addresses provided by you.
6. Shipping, Customs & Risk of Loss
Title and risk of loss for products transfer to you upon handover of goods to the international carrier.
You are the importer of record for international shipments. It is your obligation to comply with all import laws, customs declarations and tax requirements of your destination country. Any customs duties, taxes, fines or storage fees are payable by you. We will assist with commercial invoices as required but cannot predict or control customs clearance outcomes.
Shipping policy details are published separately on our Site and incorporated into these Terms.
7. Returns, Refunds & Warranty
Returns and refunds are governed by our separate Refund Policy, which is incorporated into these Terms.
Our limited product warranty covers manufacturing defects of carbon frames and wheelsets as stated in our warranty document. The warranty does not cover damage caused by improper assembly, crash, impact, abuse, modification, normal wear and tear, incorrect installation or unauthorized repair.
Warranty claims require proof of purchase and inspection evidence. We reserve the right to determine whether a product failure qualifies for warranty remedy.
Custom-made bicycle frames are generally non-returnable and non-refundable once production starts, except for confirmed manufacturing defects.
8. Intellectual Property
All content on hyggecycle.com including text, product photos, 3D renders, geometry charts, logos, brand marks, graphics and website code is the intellectual property of HyggeCycle, protected by copyright, trademark and other intellectual property laws.
You may not copy, reproduce, modify, distribute, publicly display or use our brand assets for commercial purposes without our prior written permission. You may not reverse engineer, decompile or attempt to extract source code of the Site.
You may not use our trademarks in meta tags, ads or domain names without written authorization.
9. User Conduct
You agree not to:
- Use the Site for any unlawful purpose
- Attempt to hack, disrupt, overload or damage our website or servers
- Use bots, scrapers to bulk copy our product data or pricing
- Submit false information, fraudulent orders or stolen payment details
- Interfere with other users’ access to the Site
- Post or transmit malicious software, spam, abusive or threatening content through our contact channels
Violation of this section may result in immediate account suspension, order cancellation and legal action.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HYGGECYCLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF USE, BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR PURCHASE OR USE OF PRODUCTS OR THE SITE.
Our total aggregate liability for any claim related to your order shall not exceed the total amount you paid to us for that specific product.
This limitation does not exclude liability for death or personal injury caused by our negligence, or any liability that cannot be excluded by mandatory law.
Bicycle products involve inherent risks. Proper professional assembly, inspection and safe riding practices are your responsibility. We are not liable for injuries arising from improper build, misuse or riding accidents.
11. Indemnification
You agree to defend, indemnify and hold harmless HyggeCycle, its officers, employees and suppliers from and against all claims, damages, liabilities, costs and legal fees arising from:
- Your breach of these Terms
- Your use of the Site
- Your purchase, assembly and use of our products
- Violations of law by you
- Any claims brought by third parties related to your actions
12. Dispute Resolution & Governing Law
